This article was originally a “Judgment Call” newsletter sent on May 6, 2021, to members of Rappler+, a community of supporters who are given access to exclusive content and events.

We all agree, don’t we, that in the 2022 Philippine elections we shall be dealing with the highest stakes since the snap polls of almost four decades ago? 

In 2016, when Rodrigo Duterte became president, I watched with interest the symbolisms that his election carried: a mayor trouncing national figures, a promdi making Manileños eat dust, a street-smart politician blindsiding rivals who had been going by the old campaign books, a dark horse with 16.6 million votes putting a cloak over the fact that 26 million put their bets against him through four others in the race. 

Before that election year was over, though, I realized – we all did – that we were not dealing with just another political animal whose mistakes we could charge to experience and whose six years in office we could bear until we would hopefully cast wise and discerning votes in the next polls.

More families are hungry. Millions are losing their jobs or can’t find any. Small businesses are folding up. Protesting jeepney drivers are told, who cares if they were poor and would starve to death? Thousands are dying from the coronavirus. No clear spending of billions of dollars in pandemic loans. Tens of thousands of suspected small-time drug users are killed by cops and vigilantes. Critics and activists are jailed. Independent media is crippled. The legal victory against China’s expansive claims on Philippine waters is being dismissed as “just a paper I can toss into the wastebasket.” Men in uniform are told they can rape women or shoot them in the vagina and the President’s got their back. 

At one point or another, Duterte’s spin masters have tried to explain him, in various shades, as ganyan ang Bisaya, ganyan ang taga-Mindanao, ganyan ang siga, ganyan ang mayor, ganyan ang makabayan, ganyan ang ama, ganyan ang lider. 

Ah, leader – a reminder of the unequal attention the media gives to those who want to govern and those who will be governed when we, not just Rappler, cover elections. No matter how much we set out to bring the concerns and needs of the people to the forefront, to capture their sentiments, to tune up their voices, to encourage their collective power, we end up not pushing the limits in doing so. 

That ends now. 

Rappler, for starters, has decided to drop the hashtag-slogan we’ve been using in all the elections we have covered since 2013: #TheLeaderIWant. 

The main character in the 2022 elections is going to be the voter. The campaign will be to disabuse the minds of Filipinos that there’s no more turning the tide against whoever is fielded by an administration that has governed with mediocrity, heartlessness, intimidation, and corruption – as well as brute towards imagined adversaries and subservience to the real enemy. The message is to convince every eligible citizen that his or her one vote will count. It will. It can.    

#WeDecide. This the hashtag that Rappler and our communities will start using on Monday, May 10, as we begin our coverage of the May 2022 Philippine elections. 

“Atin ang Pilipinas.” This is our rallying cry. In our coverage of the campaigns and elections, as our partner communities serve their localities and sectors, we will take back our regard for life, our respect for the others’ rights, our compassion for our neighbors, our dignity as workers, our capability to give our families a decent life. We will exact accountabilities as taxpayers. We will shed the parochial mindset to protect the country’s collective good. We will, before the world, assert our sovereignty as a nation.

We will own the elections, we will reclaim this country.

The blatant abuses of power are now codified into law. It happened in June: a regional trial court’s order changing the period of prescription for libel from 1 year to 12 years; the shutdown of ABS-CBN; and the quick passage of the Anti-Terror Law, under which a critical voice can be named a terrorist, arrested without a warrant, and jailed for up to 24 days. 

The walls are closing in. 

The Philippines is at the precipice. There’s no need to declare martial law because the very processes of democracy have been turned against it. We now live in a time that is “worse than martial law.”

It’s democracy’s death by a thousand cuts. 

The way we at Rappler have survived 4 years of attacks is by: 

1. Shining the light: Name it and demand signatures to these abuses. If we can’t get justice now, we will later. History is on our side. 

2. More hard-hitting journalism: Continue to hold the powerful to account and demand accountability for the people. Of course, the more we do that, the more the full power of the State is turned against us.

3. More innovation: We continue to explore and to build at a time of creative destruction. The Lighthouse, rolling out this week, is our latest experiment and  provides a beacon to safer shores. (Read: How Lighthouse gave us hope)

Hatred, arrogance, and incompetence can only affect you if you let it. The battle begins in our minds. (Read: Rappler ends 2019 with income: A comeback year) 

While I hate being the government’s cautionary tale, I’m not afraid. It made me stronger, solidified the values I believe in, made me draw the line I cannot cross. I will defend the mission of journalism as long as we are a democracy because press freedom is the foundation of every right of every Filipino under our Constitution. My job is to hold up the sky so our journalists can do their work. 

It’s time to ask yourself a question we’ve lived with for years now: What are you willing to sacrifice for the truth? I am at peace with my answer.

Everyone who speaks comes under attack on social media, once an enabler, now a tool for oppression. Be prepared for it. Accept this will happen. Social media is now a behavioral modification system. 

We’re demanding accountability as well from the social media platforms, but Lighthouse is also an experiment to see how tech can serve journalism and democracy. Please test it and give us your feedback. 

We can’t do this alone. The impunity of power is brazen, and the battle has now come to every Filipino. (Read: ABS-CBN’s battle is also ours)

Just the day before, petitioners went to the Supreme Court to question the constitutionality of the anti-terrorism law which President Duterte signed on July 3, oblivious to criticism and concerns about its adverse impact on human rights enshrined in the Charter.

Would the gruesome murder of Senados constitute an act of terrorism under the new law, some human rights lawyers ask. Before this new law, we had the Human Security Act of 2007 which defined terrorism as crimes that create a “condition of widespread and extraordinary fear and panic among the populace” to coerce government “to give in to an unlawful demand.”

But Duterte’s new law broadens this definition and casts a wider net. It now says the following constitute terrorist acts, as explained previously by our justice reporter Lian Buan. (READ: EXPLAINER: Comparing dangers in old law and anti-terror bill)

• Intimidation of the general public or a segment of it
• Creation of an atmosphere of fear or the spread of a message of fear
• Provocation or influence of government or any of its international organizations by intimidation
• Destabilization or destruction of fundamental political, economic or social structures of the country
• Creation of a public emergency
• Serious undermining of public safety

Compare Duterte’s law to these definitions of terrorism by the United Nations Office of the High Commissioner for Human Rights and even the US Federal Bureau of Investigation. To simplify matters, both of them essentially say that terrorism entails force, violence, or death to intimidate or coerce a government or a population to push for a particular agenda.

This narrow definition is insufficient in the world of Rodrigo Duterte and other legislators who gave their nod to this piece of legislation. Given the 6 enumerated acts, the ambush of Senados – because it certainly created a public emergency, spread a message of fear, and undermines public safety, at the very least – makes terrorists of his attackers.

Ordinary dissenters can be terrorists

But wait, it’s not just gruesome murders that make killers terrorists under the new law. Even ordinary dissenters or protesters can be tagged as terrorists if the 9-member anti-terror council (ATC) made up – not of judges, but of members of the Duterte Cabinet – say so. All they need to do is find probable cause that there is intent to cause death or harm to a person or create risk to public safety to declare a dissenter a terrorist. 

If you tweeted or posted on Facebook about a mass protest near the Palace, for example, or any government office for that matter, and encouraged people to attend it to voice immense dissatisfaction with the administration’s handling of the coronavirus pandemic, you can be easily labeled a terrorist, on the mere say-so of this all-mighty ATC. Just because you are judged to have an intent to endanger lives and public safety. But really, how does one judge intent? Will anointed Cabinet members have the gift to read minds and decipher intentions of activists like religious saints and gods? And what happens to judgments of courts that justify incarceration and loss of basic freedoms only on the basis of hard evidence? We are retrogressing and falling deeper into the abyss of authoritarianism. 

Forget about the assurances of Presidential Spokesman Harry Roque, who has turned out to be a pseudo-human rights lawyer. We got reminded of this piece he wrote for us way back 2012: Cybercrime law: See you in court, PNoy, which only shows that for him, it might have been merely faddish then to oppose the cybercrime law, as much as it is perhaps in vogue now to defend the anti-terror law. ABS-CBN

The pandemic will make the situation even more coercive than what it will foreseeably be once the law takes effect. If Kapamilya stars, employees, and fans went to the House of Representatives to protest its members’ subterfuge and ruses (to borrow the word in Maria Ressa’s cyber libel case decision) to delay or even deny the ABS-CBN franchise, they, too, can be tagged as terrorists and even violators of quarantine restrictions. Forget about freedom of speech or even freedom of assembly.

But can you imagine how one single explosion set off by rightists during any protest, whether or not related to ABS-CBN, can close the narrowing divide between democracy and authoritarianism? Remember the August 1971 Plaza Miranda bombing and the faked ambush of then-defense minister Juan Ponce Enrile that was used to justify the declaration of Ferdinand Marcos’ Martial Law?

Beyond the Philippines, we are watching closely Malaysiakini editor-in-chief Steven Gan, who faces contempt of court charges over comments supposedly critical of the Malaysian judiciary which were posted by readers on their site. Clearly an act of intimidation to silence independent media.

The June 29 broad daylight rubout in Jolo – in the Army’s words – characterizes in so many ways the last 4 years of Rodrigo Duterte’s presidency, which began on June 30, 2016. His first marching order the day after he took his oath of office was addressed to the Philippine National Police (PNP): “Do your duty and if in the process you kill 1,000 persons because you were doing your duty, I will protect you,” he told police officers gathered at Camp Crame on July 1, 2016. 

The absolute power of a police force that takes no prisoners – even their better-equipped and more formidable brothers in arms.

The neglect of the real security threat – terrorism, especially in Sulu – in lieu of the easy and convenient enemy called the New People’s Army. 

Rules of engagement made meaningless by presidential shoot-to-kill orders.

Reward redefined as something that’s given for bad behavior.

Former armed forces chief Ricardo Visaya raged and ranted on Facebook, calling out the PNP for tolerating its abusive men. 

It must be hard to see this done in your own backyard, right? Because for years the guns were aimed at the unarmed and those so far out of the power corridors as to even squeak. (Recommended read: 4 years on, climate of fear and impunity blocks justice for Duterte’s drug war victims)

Mamasapano and Magalong  

There was a time the PNP stood for what is right, even if it meant hurting their president. 

In March 2015, then police director Benjamin Magalong submitted to then president Benigno Aquino III the report of a fact-finding committee that probed the police-led Mamasapano operation that ended up killing 44 members of the PNP’s Special Action Force (SAF). 

The PNP under Aquino was not spared the presidential whim, an affliction that visits leaders who think the police can – and should be – at their beck and call. Without telling the military and even the superiors of the PNP, he approved a clandestine SAF operation against a top international terrorist holed out in a fortified stronghold in Maguindanao, leaving them like lambs to the slaughter. 

Magalong led the probe into the fiasco, and concluded that Aquino bypassed the chain of command. 

There was a time a police general not only braved presidential ire, he was also given the time to explain himself by his president. So that whatever Aquino’s fatal mistakes in that operation, I long to see that moment again: on March 17, 2015, Aquino and Magalong met in Malacañang to discuss the damning report against the president then. “He was visibly hurt,” Magalong would tell reporters later about the meeting. But the discussion remained cordial, orderly, straightforward.

Today, the public continues to benefit from professionals like Magalong.

As mayor of Baguio City, he has applied his operational skills and vast experience to stem the coronavirus tide against his constituents. 

It is no coincidence that as we marked Duterte’s 4th year in office, we featured this retired police general who is showing everyone how the nation can benefit from policemen who do good.

Fifth, that the resilience of the economy is built over the years under many presidents – and every good or bad decision made is put to a test on the global stage. 

Two more years 

Assuming elections push through in 2022 (you’ll never know in the current world order), we are now entering the last two years of President Duterte. 

If there’s anything we’re certain of, it is that it will continue to be hell for his critics and independent voices.
